K-TAP Product Liability Disclaimer

This Product Liability Disclaimer ("Disclaimer") governs the purchase and use of all "K-TAP" products, including but not limited to metal NFC digital business cards, NFC mobile stickers, Google review stands and cards, card holders, QR-coded products, premium laser-printed cards, and any associated digital profiling services (collectively, the "Products"), provided by K Y Digital Solutions LTD (Company No. 16981689) ("Company", "we", "us" or "our").

By purchasing or using the Products, you ("User" or "Customer") expressly acknowledge and agree to the terms set forth in this Disclaimer.

1. "As-Is" and "As-Available" Basis; Warranty Limitations

All K-TAP Products and any associated digital profiling services are provided on an "as-is" and "as-available" basis unless we expressly state otherwise in writing. To the maximum extent permitted by applicable law, the Company makes no representations or warranties of any kind, whether express, implied or statutory, including (without limitation) any implied warranties of satisfactory quality, merchantability, fitness for a particular purpose, non-infringement, or that the Products will be uninterrupted, error-free, or free from defects.

Nothing in this Disclaimer limits or excludes any rights or remedies that cannot lawfully be limited or excluded under applicable consumer protection law.

2. Technical Compatibility and Device Limitations (Third-Party Devices)

User acknowledges that the functionality of NFC-enabled Products and QR-coded Products depends on the hardware, software, settings, and connectivity of third-party devices and services (e.g., smartphones, tablets, operating systems, camera apps, NFC readers, browsers, and mobile network/Wi-Fi). The Company does not warrant that:

  • The Products will be compatible with all mobile devices, operating systems, camera applications, or NFC implementations.
  • NFC or QR code interactions will function in all environments, lighting conditions, cases/covers, or with all device settings (including when NFC is disabled).
  • Any third-party device used by an end-user is capable of receiving, processing, displaying, or securely handling the data transmitted or accessed via the Product.

Device manufacturers and third-party platforms may change features, security settings, and supported standards at any time, which may affect functionality. The Company has no responsibility for such third-party changes.

3. Physical Products: Handling, Wear-and-Tear, and Misuse

K-TAP metal cards, stickers, Google review stands/cards, and card holders are physical products that may be subject to wear and tear. User understands and agrees that:

  • Slight variations in colour, texture, engraving depth, printing, alignment, or finish may occur and are not necessarily defects.
  • The lifespan and performance of any printed/engraved surface, adhesives, stands, holders, and any embedded NFC chip or QR code are affected by normal wear and tear, environmental exposure (including heat, moisture, liquids, sunlight, abrasion, chemicals, and magnetic/electromagnetic fields), and user handling.
  • The Company is not liable for damage, failure, or reduced performance resulting from misuse, abuse, improper handling, improper installation/placement, unauthorised modification/repair, use contrary to instructions, negligent use, or improper storage (including scratching, bending, crushing, puncturing, cutting, water damage, or exposure to extreme conditions).

Users are responsible for safe handling and keeping Products away from hazards and out of reach of children where appropriate. Card holders and stands are accessories and should be used only for their intended purpose.

4. Digital Content, Data Security, and User Legal Compliance

The K-TAP Products may link to digital profiles, URLs, and data and may enable data transmission or access via NFC and/or QR technology.

  • Data Accuracy: The User is solely responsible for the accuracy, legality, and appropriateness of the content, links, and information associated with their K-TAP profile and any destination websites or services.
  • Local Law Compliance (NFC/QR Data Sharing): The User is solely responsible for ensuring that their use of the Products and any sharing, collection, or processing of personal data via NFC/QR complies with all applicable laws and regulations in their jurisdiction(s) (including, where applicable, UK GDPR, EU GDPR, and other privacy, marketing, consumer protection, and e-commerce rules). This includes providing any required notices and obtaining any required consents.
  • No Liability for Data Loss / Unauthorised Access: To the maximum extent permitted by law, the Company is not liable for any data loss, corruption, interception, unauthorised access, tracking, scraping, cloning, or misuse of information that occurs in connection with the use of NFC/QR technology, third-party devices, third-party networks, or third-party platforms, including any loss arising from malware, phishing, or redirected links outside the Company's reasonable control.
  • Security / Lost or Stolen Products: The Company is not responsible for unauthorised use of a Product if it is lost, stolen, or accessed by a third party. The User should promptly notify the Company to request deactivation or changes to the associated destination link(s), where such controls are available.

5. Third-Party Platforms (Google Reviews and Social Media)

For Products specifically designed for "Google Review" stands or social media redirection:

  • K Y Digital Solutions is not affiliated with Google, Meta, or any other third-party platform.
  • We do not guarantee that the use of K-TAP Products will result in an increase in reviews, followers, or business metrics.
  • The Company is not liable for any account suspensions or penalties imposed by third-party platforms resulting from the use of K-TAP Products.

6. Limitation of Liability (Including NFC/QR Malfunctions)

To the maximum extent permitted by applicable law, the Company (and its directors, officers, employees, contractors, or agents) shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, including (without limitation):

  • Loss of business, revenue, profits, goodwill, or anticipated savings.
  • Data loss, corruption, interception, unauthorised access, or security incidents associated with NFC/QR usage.
  • Any claim arising from misuse, improper handling, improper installation/placement, unauthorised modification, or use of the Products contrary to instructions or intended purpose.
  • Personal injury or property damage to the extent caused by misuse, improper handling, negligence, or unauthorised modification/repair by the User or a third party.
  • Technical malfunctions, intermittent performance, or failures of the NFC chip, NFC antenna, QR code readability, printed/engraved QR accuracy, encoding errors, redirection issues, or link/URL errors, including issues that arise after delivery, testing, normal wear and tear, or as a result of third-party device limitations or software updates.

In all circumstances and to the maximum extent permitted by law, the Company's total aggregate liability arising out of or in connection with the Products or this Disclaimer shall not exceed the amount paid by the Customer for the specific Product giving rise to the claim.

Nothing in this Disclaimer excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

7. Indemnification

User agrees to indemnify, defend, and hold harmless K Y Digital Solutions from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with the User's misuse of the Products or violation of this Disclaimer.

8. Governing Law (United Kingdom) and Jurisdiction

This Disclaimer and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it, its subject matter, or its formation shall be governed by and construed in accordance with the laws of England and Wales.

The parties irrevocably agree that the courts of England and Wales, sitting in London, shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Disclaimer or the Products.

9. Modifications

K Y Digital Solutions reserves the right to modify this Disclaimer at any time. Continued use of the Products following any such changes constitutes your acceptance of the new terms.
